The Supreme Court is poised to announce its decision regarding interim bail for Delhi Chief Minister Arvind Kejriwal in the excise policy case on Friday, May 10. Justice Sanjiv Khanna, heading the bench that recently reserved its verdict on the matter, indicated that the ruling is expected on Friday.
Earlier this week, the court hinted at the possibility of interim bail for Kejriwal, considering the ongoing general elections. However, concerns were raised about allowing him to carry out his official duties during the bail period due to potential conflicts.
The bench, also comprising Justice Dipankar Datta, expressed reservations about Kejriwal performing official functions while on interim bail, stating it could lead to conflicts. The court acknowledged Kejriwal’s unique position as both the Chief Minister and the convener of the Aam Aadmi Party during the elections, terming it an “extraordinary situation.”
While the Enforcement Directorate (ED) urged the court not to grant bail, citing concerns about treating politicians differently from ordinary citizens, the court recognized the exceptional circumstances of the case. It emphasized the need to avoid interference in the functioning of the government.
The case revolves around allegations of irregularities in Delhi’s excise policy, initially probed by the Central Bureau of Investigation (CBI) following a recommendation by Delhi’s LG in July 2022. Kejriwal, currently in judicial custody, is the third AAP leader arrested in connection with the case.
The decision on interim bail for Kejriwal is eagerly awaited, especially with the upcoming general elections in Delhi and Punjab. The court’s ruling is expected to be crucial, with election results slated to be announced on June 4.
